Facilitation of EU labour operations urgently needed


The VDMA European Office and the departments of foreign trade and law took an appointment with representatives of the European Labour Authority (ELA) on 22 September 2020.

The ELA wants to contribute to the fair, simple and effective enforcement of EU regulations on labour mobility and social security coordination in the EU Member States.

VDMA repeated its demands for simplifications for work assignments of employees in the EU, for example the exemption from administrative and labour law obligations for short EU assignments and harmonised reporting regulations in the 27 EU Member States. In addition, VDMA pointed out two main problems with the revised Posting of Workers Directive: For example, there are major practical challenges for companies to correctly apply the now valid principle of "equal pay for equal work in the same place" due to the frequent "collective agreement jungle" in the respective target country. Furthermore, with regard to the other framework conditions of labour law, especially in the case of long-term postings of employees, it is also apparent that the information provided by the Member States to date is generally inadequate.

VDMA will continue to regularly discuss the bureaucratic situation for its member companies regarding the implementation of the Posting of Workers Directive and the EU notification requirements with the EU institutions.
